Poll: The rules for ties

Fury and Swing Time had both 65 points in 1936-38 poll. Instead of tiebreak I want to make a rule which one will win in case of tie. So choose your option and vote for it. If you choose the one with the highest vote your vote goes to Fury (the highest vote was #3 by Miche) if you choose The one with more votes Swing Time will get a point (4 votes vs. 2 votes).

The option: The one with more votes (and if the movies have same amount of votes the one with the highest vote) means that if two movies have 70 points (and the first one has #1 and #6 votes (50+20=70) and the second one #2 and #4 votes (40+30=70) should the one with higher vote (#1) win in these cases or the second highest vote (#2).
